A Consultants worse nightmare!

The phone rings in the middle of the night……it’s a client…..you haven’t heard from them in a couple of years…..you assume everything is okay but the client is calling from the Immigration Detention Center. He has been detained and is being held for staying in Canada illegally! He’s desperate for your help.

How can this be? You remember having completed his work permit application. The story comes out slowly. Didn’t we get a positive LMO and do your work permit application 2 years ago? The client responds: “Yes we did but I never filed it”. What! Why?

This was definitely an “Oh My God” moment for me. I’m use to having successful cases with positive approvals. What can I do for this client? This is not a question of whether or not we can win this case. The client has been in Canada illegally for 2 years, working and to make matters worse, he was promoting his business on his Facebook page (easy documentation for the CBSA officer in their case against him). There is no winning to be had in this case. He will have to leave Canada because of his failure to file his work permit application. What can I possibly do for him?

It’s frustrating because I want to win this case but can’t. I have to do what I can. What I can do is get him out of detention and minimize the damage (make sure that he can eventually return to his life in Canada). This is a tough case because he knew he was in Canada illegally and he knew he needed a work permit. There was no excusing the clients performance.

I knew that if I accomplish these things it would be as close to a success as we could achieve.
If I got him out of detention, he could get his things in order before he was required to leave the country and if I could minimize the extent of the exclusion order he could return after 1 year.
The CBSA officer was asking for permanent deportation. It was going to be a tough fight.

Before the deportation hearing, I requested that my client bring $5000 as a security bond. I felt that this would indicate our desire to leave as requested and not require further detention.
I felt that with the bond I could get him released and now what I needed was a little luck in finding a sympathetic judge who was willing to listen to my arguments that my client wasn’t a bad person but just a decent person who made a decidedly poor decision but youthful decision to forego filing his Work Permit (after all he had received a positive LMO).

Luck was with us and I got the client released and even though he will need to leave Canada soon, the judge was listened and didn’t impose a permanent deportation order contrary to the CBSA officers request. We now have breathing room to contemplate a strategy for his return in a years. It wasn’t perfect but it was the best we could expect. I know it. My client knows it.

God, I hate those late night phone calls!

Updated Immigration Regulation

On June 24th, 2011, Citizenship and Immigration Canada (CIC) has announced new guideline in regard to updated Immigration Regulations, which will come into force on July 1st, 2011. There was no huge change except for the Business Immigration Categories. Please let me explain the changes program by program

1. Federal Skilled Worker (FSW)

Last year, CIC reduced the number of the eligible occupations for the Skilled Worker program from 38 to 29. According to the announced new guideline, the list of the 29 eligible occupations will remain the same for the coming 12 months. However, the cap limits have been decreased to 500 per each occupation, which was originally 1000. In addition, CIC will only process 10,000 FSW applications without an AEO for the next 12 months. After reaching the cap limits, CIC will not process any FSW application. As for the 29 eligible occupation, please refer to the below list

The AEO (Arranged Employment Offer) options will be still valid for the next 12 months. In order to qualify for the Federal Skilled Worker program under the AEO option, applicants must have a permanent, must be full-time job offer from a Canadian employer AND:

a. The job offer authorized by Service Canada, which is called Arranged Employment Opinion, OR
b. Applicants are currently working full-time for the employer who has offered the permanent employment

As you are aware, if you have applied for a Permanent Resident Visa under the b option, it is your responsibility to maintain your legal status while your FSW application is being processed by CIC. If you fail to meet the requirement, it may result in a refusal of your Permanent Resident Visa.

2. Federal Investor’s Class

Federal Investor applications received from July 1st, 2011 will be assessed pursuant to the current regulations. However, a maximum of 700 applications worldwide will only be considered for processing.

We are speculating that the 700 caps will be reached very quickly. If you are considering the Federal Investor Class as an option for you to immigrate to Canada, we strongly recommend that you finalize and submit your application as soon as possible. 3. Federal Entrepreneur Class

No Federal Entrepreneur application will be accepted from July 1st, 2011 until CIC announces any further notice. Please ensure that your application is received by CIC before July 1st, 2011.

Applications under Provincial Nominee Programs, Canadian Experience Class, Sponsorship and other programs will be processed in accordance with the existing regulations.

오늘 이렇게 뉴스레터를 발송하는 이유는 7월 1일부터 시행되는 개정이민법을 안내해드리기 위함입니다. 작년과는 달리 비지니스 카테고리를 제외한 나머지 이민 프로그램은 큰 변경사항이 없으며, 프로그램 별로 상세히 설명드리도록 하겠습니다.

1. 연방 전문인력이민 (Federal Skilled Worker)

2010년도에 발표된 29개 직업군은 변경사항이 없으나, 각 직업군에 부여된 Cap 의 수는 1000 -> 500 으로 50% 가 감소되었으며, 전체 Cap 역시 20,000 -> 10,000 로 50% 가 감소되었습니다. 변경된 Cap 은 7월 1일부터 2012년 06월 30일까지 접수되는 신청서류에 적용되며, 29개 직업군 목록은 아래와 같습니다.

AEO (Arranged Employment Offer) 에 대한 옵션은 현행조건과 동일합니다. 캐네디언 고용주로 부터 받은 영구 고용제안 및:

b. 적법한 취업비자를 소지한채 잡오퍼를 제안한 고용주 밑에서 풀타임으로 고용되어 있어야 합니다.

다들 아시고 계시듯이, 조건 b 의 경우 영주비자가 발급될때까지 합법적인 신분을 반드시 유지하고 계셔야 하며, 이를 실패할 시 신청서류의 거절을 초래할 수 있습니다.

2. 연방 순수투자이민 (Federal Investor’s Class)

2011년 7월 1일부터 접수되는 연방 순수투자이민 신청서류는 현행기준과 동일한 자격조건으로 심사될 것이나, 내년 6월 30일까지 최대 700개의 신청서류만을 심사할 것이라고 캐나다 이민성에서 발표하였습니다.

정해진 Cap 은 7월 한달이면 마감될 것으로 예상되오니, 순수투자이민 신청을 고려해오고 계셨던 분들은 신속하게 신청서류를 접수하시길 권장드립니다. 연방 순수투자이민 관련하여 의문사항 혹은 전문법률 도움이 필요하신 분들은 저희 사무실로 연락주시기 바랍니다. (전화: 604-904-2233, 이메일: visa@imin.ca)

3. 연방 기업이민 (Federal Entrepreneur)

2011년 7월 1일부터 캐나다 이민성의 추후 발표가 있기 전까지 연방 기업이민 신청서류 접수는 일시적으로 중단될 것입니다. 신청서류를 준비중이셨던 분들은 서둘러 접수를 하셔야 할 것입니다.

그 밖의 주정부 이민 (Provincial Nominee Program), 캐나다 경험이민 (Canadian Experience Class), 초청이민 (Sponsorship) 등은 현행 이민법과 동일한 기준으로 자격여부을 심사될 것입니다.

Actualización en regulaciones migratorias

El 24 junio del 2011, Citizenship and Immigration Canada (CIC) ha anunciado nuevas disposiciones con respecto a las actualizaciones en regulaciones migratorias las cuales entrarán en vigor el 1 de julio del 2011. No hubo grandes cambios a excepción de la clasificación de migración en negocios, por favor permítanme explicarles los cambios en cada programa.

1 Federal Skilled Worker (FSW)

El año pasado, CIC redujo el número de ocupaciones elegibles para el programa de Skilled Worker de 38 a 29, de acuerdo a lo anunciado a las nuevas disposiciones, la lista de 29 ocupaciones seguirán siendo las mismas en los próximos 12 meses, como sea, el límite ha sido reducido a 500 por ocupación cuando originalmente era 1000. Adicionalmente CIC solamente procesará 10,000 aplicaciones dentro de la categoría FSW sin un AEO (Arranged Employment Offer / Oferta formal de trabajo) en los próximos 12 meses. Después de alcanzar esos límites, CIC no procesará ninguna aplicación dentro de la categoría FSW. Con respecto a las 29 ocupaciones que son elegibles por favor observen la siguiente lista.

0811 Gerentes de cualquier proceso de producción primaria (con excepción de agricultura)

La opción de AEO (Arranged Employment Offer- Oferta formal de trabajo) seguirá valida por los siguientes 12 meses. Para poder calificar para el Federal Skill Worker (FSW) bajo la opción AEO, los aplicantes deben tener una oferta de empleo permanente y de tiempo completo por parte de un empleador Canadiense Y:

a. Una oferta de trabajo autorizada por Service Canada, la cual es la misma AEO Ó
b. Los aplicantes deben trabajar de tiempo completo para su empleador, quien ha ofrecido el empleo permanente.

Como se podrán dar cuenta si ustedes han aplicado por una Visa de Residente Permanente bajo la opción b, es su responsabilidad mantener su estatus legal mientras la aplicación como FSW está siendo procesada por CIC. Si ustedes fallan en este requerimiento, su Visa de Residente Permanente puede ser rechazada.

2. Federal Investor class (Clasificados como Inversionistas federales)

Las aplicaciones como Federal Investor recibidas a partir del 1 de julio del 2011 serán procesadas bajo las regulaciones actuales, como sea, un máximo de 700 aplicaciones a nivel mundial serán consideradas para su proceso.

Consideramos que ese límite de 700 aplicaciones será cubierto rápidamente, Si ustedes están considerando el Federal Investor como una opción para migrar a Canadá, les recomendamos ampliamente que envíen su solicitud lo más rápido posible. 3. Federal Entrepreneur Class (Clasificación de Empresario federal)

Ninguna aplicación para Federal Entrepreneur será aceptada a partir del 1 de julio del 2011 hasta que CIC anuncie una nueva disposición. Por favor asegúrense que su aplicación sea recibida por CIC antes del 1 de julio del 2011.
Las aplicaciones bajo Provincial Nominee Programs, Canadian Experience Class, Sponsorship y otros programas serán procesados de acuerdo a las regulaciones actuales.

A brief Canadian History lesson

Many of us (including myself) are immigrants and we all love the fact that July 1st is a legal holiday in Canada, appropriately named Canada Day but as immigrants do we really know the history of Canada Day (unarguably Canada’s most important holiday)?

Here is my brief history of Canada.

Before July 1, 1867, Canada was 3 separate British Colonies (New Brunswick, Nova Scotia and the Province of Canada). On July 1, 1867, the British crown combined the three colonies to form the Kingdom of Canada. The Kingdom of Canada was made a self governed state but still a protectorate of the British Empire which had some considerable sway over the politics of the country. It actually wasn’t until 1982 that Canada obtained complete sovereign Independence from Great Britain. It’s history as a long standing member of the Commonwealth is still felt in the style of government, culture and even linguistics but Canada is never the less an independent and sovereign state and we celebrate that sovereignty on July 1st. Happy Birthday Canada!
